I agree with you that the superinjunction thing was (well, still is, technically) absolutely NUTS. However, I don't know that it was a factor in this particular case. Mr. Justice Tugendhat lifted the superinjunction on January 29, 2010. The apology seems to refer to information published on January 31, so two days later.
